Overall, I feel very good about the trial. Your testimony was outstanding. I loved how you stood your ground on cross exam. On behalf of all my siblings, we are so very grateful for your willingness to do the research, write your 18 page report, meet with our attorneys and testify with great conviction and authority.
These were the Miami County Judge’s findings: At the end of the trial Friday afternoon, he gave two rulings. And your testimony played a MAJOR role is his rulings. 1) Trustee breeched her duty as trustee by “failure to account.” He read from the trust instrument, article 8 which specifies those duties. Judge also quoted the opposition expert witness, “Communication between Betty Jones and the beneficiaries could have been handles much better.” It was highly inadequate. Judge also read from your report on pages 13 and 17 where you spell out those breeches. Then he said this ruling has several implications which he will address in his final ruling.
2) The second ruling was about attorney’s bill. In a counter claim, this was one item the Estate wanted the Family Trust to pay. Judge said the Family Trust would not be paying for attorney’s bill for 3 reasons: a) attorney or someone had to work on the records because trustee breeched her duty to account. b) attorney’s work was necessary to be able to pass it on to the successor trustee and to satisfy the IRS. c) attorney’s bill reflected that she worked on multiple entities. The Family Trust was just one of those entities.
